1. Introduction

These Terms and Conditions (“Terms”) govern your use of the FundCollector WordPress plugin (“Plugin”,
“Software”) developed and distributed by Bruno Alesiani (“Author”, “We”, “Us”).

By downloading, installing, or using FundCollector, you acknowledge that you have read, understood, and
agree to be bound by these Terms.

2. License

FundCollector is licensed under the GNU General Public License version 2 (GPL v2) or any
later version.

2.1 Your Rights

You are free to:

  • Use the Plugin for any purpose, including commercial use
  • Study how the Plugin works and modify it to suit your needs
  • Redistribute copies of the original Plugin

FundCollector is distributed in the hope that it will be useful, but WITHOUT ANY

; without even the implied warranty of MERCHANTABILITY or
FITNESS FOR A PARTICULAR PURPOSE.

The Author does not warrant that:

  • The Plugin will meet your specific requirements
  • The Plugin will operate uninterrupted or error-free
  • All errors or defects will be corrected
  • The Plugin is compatible with all WordPress configurations
  • Third-party integrations (e.g., PayPal) will function without issues
  • Data will be processed or stored without loss or corruption

3.2 Third-Party Services

FundCollector integrates with third-party services including, but not limited to:

  • PayPal payment processing
  • Google reCAPTCHA
  • Email services

The Author is not responsible for the availability, reliability, or functionality of these third-party
services. Any issues arising from third-party service failures, changes to their APIs, or terms of
service are beyond our control and responsibility.

4. Limitation of Liability

NO LIABILITY: In no event shall the Author or copyright holders be liable for any
claim, damages, or other liability arising from the use of this software.

4.1 Exclusion of Damages

The Author shall not be liable for any damages including, but not limited to:

Financial Damages

  • Loss of funds, donations, or revenue
  • Failed or incomplete transactions
  • Payment processing errors
  • Currency conversion issues
  • Bank or payment gateway fees
  • Chargebacks or refund disputes

Operational Damages

  • Service interruptions or downtime
  • Loss of business or donations
  • Loss of data or corruption
  • System crashes or conflicts
  • Integration failures with third-party services

Consequential Damages

  • Loss of profits or revenue
  • Loss of goodwill or reputation
  • Legal costs or compliance penalties
  • Indirect, incidental, or consequential damages
  • Special or punitive damages

4.2 Maximum Liability

To the maximum extent permitted by applicable law, the Author’s total liability shall not exceed the
amount you paid for the Plugin (which is zero for the free version distributed via WordPress.org).

5. No Financial Compensation

No financial compensation, refunds, or damages will be provided for any errors,
malfunctions, bugs, or issues arising from the use of this Plugin, including but not limited to:

  • Software bugs or programming errors
  • Configuration or setup issues
  • Compatibility problems with WordPress, themes, or other plugins
  • Data loss or corruption
  • Security vulnerabilities or breaches
  • Performance issues or slow operation
  • Failed updates or upgrades

6. User Responsibilities

By using FundCollector, you acknowledge and agree that you are solely responsible for:

    amounts before accepting real donations
  • Transaction Monitoring: Regularly monitoring and reconciling all transactions

    theme, and other plugins

6.2 Security and Maintenance

  • Regular Backups: Maintaining regular backups of your website and database
  • Security Updates: Keeping WordPress, themes, plugins, and server software up to
    date
  • Access Control: Securing admin credentials and limiting access to authorized
    personnel only
  • SSL/HTTPS: Using SSL certificates to encrypt data transmission

6.3 Legal Compliance

  • Local Laws: Ensuring compliance with applicable laws and regulations in your
    jurisdiction
  • Tax Regulations: Handling tax reporting and compliance for donations received
  • Data Protection: Complying with GDPR, CCPA, and other privacy regulations
  • Financial Regulations: Meeting requirements for nonprofit organizations, charities,
    or fundraising activities
  • Terms of Service: Complying with PayPal’s and other third-party services’ terms of
    service

6.4 Operational Responsibilities

  • Donor Communication: Providing timely receipts, acknowledgments, and communication
    to donors
  • Fund Management: Properly managing and accounting for all donations received
  • Dispute Resolution: Handling donor disputes, chargebacks, and refund requests
  • Record Keeping: Maintaining accurate records of all transactions and donor
    information

7. Data and Privacy

7.1 Data Collection

FundCollector collects and stores donor information including:

  • Personal information (name, email, address, phone number)
  • Payment information (processed through PayPal, not stored locally)
  • Transaction details and donation history
  • IP addresses and browser information (for security purposes)

7.2 Data Security

While FundCollector implements security measures including data encryption, you acknowledge that:

  • No system is 100% secure from unauthorized access
  • You are responsible for implementing additional security measures
  • The Author is not liable for data breaches or unauthorized access
  • You must comply with applicable data protection regulations

7.3 Data Retention

You are responsible for:

  • Determining appropriate data retention periods
  • Implementing data deletion procedures
  • Handling data subject access requests
  • Complying with “right to be forgotten” requirements

8. Updates and Support

8.1 Software Updates

The Author may provide updates, bug fixes, and new features at their discretion. However:

  • Updates are provided “as is” without warranty
  • There is no guarantee of regular updates or ongoing development
  • Updates may introduce new bugs or compatibility issues

10. Indemnification

damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your non-compliance with applicable laws or regulations
  • Any transactions or donations processed through the Plugin

11. Termination

These Terms remain in effect until terminated. You may terminate your use of the Plugin at any time by
uninstalling it. The Author may discontinue the Plugin at any time without notice.

Upon termination:

  • You must cease all use of the Plugin
  • You retain responsibility for any data collected while using the Plugin
  • Sections regarding limitations of liability and indemnification survive termination

12. Changes to Terms

The Author reserves the right to modify these Terms at any time. Changes will be effective immediately
upon posting. Your continued use of the Plugin after changes constitutes acceptance of the modified
Terms.

It is your responsibility to review these Terms periodically for changes.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to
its conflict of law provisions.

Any disputes arising from these Terms or the use of the Plugin shall be subject to the exclusive
jurisdiction of the court of Rome, Italy.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining
provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with the GNU General Public License v2, constitute the entire agreement between you
and the Author regarding the use of FundCollector and supersede all prior agreements and understandings.

17. Acceptance of Terms
