FundCollector WordPress Plugin

1. Introduction

These Terms and Conditions (“Terms”) govern your use of the FundCollector WordPress plugin (“Plugin”,
“Software”) and its premium extension FundCollector Pro (“Pro Plugin”), developed and distributed by
Bruno Alesiani (“Author”, “We”, “Us”).

By downloading, installing, or using FundCollector or FundCollector Pro, you acknowledge that you have
read, understood, and agree to be bound by these Terms.

2. License

FundCollector and FundCollector Pro are both licensed under the GNU General Public License version
2 (GPL v2)

2.1 FundCollector Pro License

FundCollector Pro is a premium extension that requires a paid license to receive updates and support. By
purchasing a Pro license, you agree to the following terms:

  • A single Pro license may be activated on up to 2 websites
  • Each license includes 1 year of updates and premium support from the purchase date
  • After the license period expires, the plugin continues to function but updates and support are no
    longer provided
  • You may renew your license at any time to restore updates and support
  • The license is non-transferable and may not be resold or shared
  • License activation requires communication with fundcollector.net servers for validation

2.2 Refund Policy

We offer a 14-day money-back guarantee for FundCollector Pro, subject to the following
conditions:

  • The refund request must be submitted within 14 days of the original purchase date
  • Refund requests must be submitted via fundcollector.net/support/
  • No refunds are provided after the 14-day period
  • Upon approval of a refund, all license activations will be permanently revoked;
    you may no longer use FundCollector Pro on any website under any circumstances
  • Following a refund, access to updates, downloads, and support will be
    immediately revoked. Continued use of FundCollector Pro
    without an active license is not recommended, as you will not receive
    security updates or support.

2.3 Subscription Cancellation

If you purchased FundCollector Pro with an annual subscription, you may cancel that
subscription at any time using either of the following:

3. Disclaimer of Warranty

IMPORTANT: This software is provided “AS IS” without warranty of any kind, either
expressed or implied, including, but not limited to, the implied warranties of merchantability and
fitness for a particular purpose.

3.1 No Warranty

FundCollector and FundCollector Pro are distributed in the hope that they will be useful, but
WITHOUT ANY WARRANTY; without even the implied warranty of
MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE.

The Author does not warrant that:

  • The Plugin will meet your specific requirements
  • The Plugin will operate uninterrupted or error-free
  • All errors or defects will be corrected
  • The Plugin is compatible with all WordPress configurations
  • Third-party integrations (e.g., PayPal, Mollie) will function without issues
  • Data will be processed or stored without loss or corruption
  • Exported reports or generated PDF receipts will be accurate or complete
  • Backup files will be restorable in all circumstances

3.2 Third-Party Services

FundCollector and FundCollector Pro integrate with third-party services including, but not limited to:

  • PayPal payment processing
  • Mollie payment processing (Pro only)
  • Google reCAPTCHA
  • Email services
  • fundcollector.net (license validation and updates, Pro only)

The Author is not responsible for the availability, reliability, or functionality of these third-party
services. Any issues arising from third-party service failures, changes to their APIs, or terms of
service are beyond our control and responsibility.

3.3 No Transaction Fees or Commissions

FundCollector does not charge any platform fee, percentage, or commission on donations or
transactions processed through the Plugin.

Every donation collected goes directly and entirely to you, the site owner, through your own payment
gateway account. The only fees applied to transactions are those charged by the payment gateway
provider (e.g., PayPal, Mollie) according to their own pricing. The Author has no involvement in and
derives no financial benefit from the transactions processed through the Plugin.

4. Limitation of Liability

NO LIABILITY: In no event shall the Author or copyright holders be liable for any
claim, damages, or other liability arising from the use of this software.

4.1 Exclusion of Damages

The Author shall not be liable for any damages including, but not limited to:

Financial Damages

  • Loss of funds, donations, or revenue
  • Failed or incomplete transactions
  • Payment processing errors
  • Currency conversion issues
  • Bank or payment gateway fees
  • Chargebacks or refund disputes

Operational Damages

  • Service interruptions or downtime
  • Loss of business or donations
  • Loss of data or corruption
  • System crashes or conflicts
  • Integration failures with third-party services
  • Inaccurate or incomplete reports or analytics
  • Failed, incomplete, or corrupted backup and restore operations

Consequential Damages

  • Loss of profits or revenue
  • Loss of goodwill or reputation
  • Legal costs or compliance penalties
  • Indirect, incidental, or consequential damages
  • Special or punitive damages

4.2 Maximum Liability

To the maximum extent permitted by applicable law, the Author’s total liability shall not exceed the
amount you paid for the Plugin. For the free version distributed via WordPress.org, this amount is zero.
For FundCollector Pro, this amount is limited to the license fee paid for the current license period.

5. No Financial Compensation

No financial compensation, refunds, or damages will be provided for any errors,
malfunctions, bugs, or issues arising from the use of this Plugin, including but not limited to:

  • Software bugs or programming errors
  • Configuration or setup issues
  • Compatibility problems with WordPress, themes, or other plugins
  • Data loss or corruption
  • Security vulnerabilities or breaches
  • Performance issues or slow operation
  • Failed updates or upgrades

This section does not affect the 14-day money-back guarantee described in section 2.2, which applies
exclusively to FundCollector Pro license purchases under the stated conditions.

6. User Responsibilities

By using FundCollector, you acknowledge and agree that you are solely responsible for:

6.1 Testing and Validation

  • Sandbox Testing: Testing the Plugin in a sandbox or staging environment before
    deploying to production
  • Payment Verification: Verifying all payment configurations and testing with small
    amounts before accepting real donations
  • Transaction Monitoring: Regularly monitoring and reconciling all transactions
  • Compatibility Testing: Ensuring the Plugin is compatible with your WordPress setup,
    theme, and other plugins

6.2 Security and Maintenance

  • Regular Backups: Maintaining regular backups of your website and database
  • Security Updates: Keeping WordPress, themes, plugins, and server software up to
    date
  • Access Control: Securing admin credentials and limiting access to authorized
    personnel only
  • SSL/HTTPS: Using SSL certificates to encrypt data transmission

6.3 Legal Compliance

  • Local Laws: Ensuring compliance with applicable laws and regulations in your
    jurisdiction
  • Tax Regulations: Handling tax reporting and compliance for donations received
  • Data Protection: Complying with GDPR, CCPA, and other privacy regulations
  • Financial Regulations: Meeting requirements for nonprofit organizations, charities,
    or fundraising activities
  • Terms of Service: Complying with PayPal’s, Mollie’s, and other third-party
    services’ terms of service

6.4 Operational Responsibilities

  • Donor Communication: Providing timely receipts, acknowledgments, and communication
    to donors
  • Fund Management: Properly managing and accounting for all donations received
  • Dispute Resolution: Handling donor disputes, chargebacks, and refund requests
  • Record Keeping: Maintaining accurate records of all transactions and donor
    information

7. Data and Privacy

7.1 Data Collection

FundCollector collects and stores donor information including:

  • Personal information (name, email, address, phone number)
  • Payment information (processed through PayPal or Mollie, not stored locally)
  • Transaction details and donation history
  • IP addresses and browser information (for security purposes)

FundCollector Pro additionally communicates with fundcollector.net for:

  • License activation and periodic validation
  • Automatic update checks

No donation data is transmitted to fundcollector.net. All donation data remains on your server.

7.2 Data Security

While FundCollector implements security measures including data encryption, you acknowledge that:

  • No system is 100% secure from unauthorized access
  • You are responsible for implementing additional security measures
  • The Author is not liable for data breaches or unauthorized access
  • You must comply with applicable data protection regulations

7.3 Data Retention

You are responsible for:

  • Determining appropriate data retention periods
  • Implementing data deletion procedures
  • Handling data subject access requests
  • Complying with “right to be forgotten” requirements

8. FundCollector Pro Features

This section governs the use of features available exclusively in FundCollector Pro.

8.1 Mollie Payment Gateway

FundCollector Pro includes an integration with Mollie B.V. (“Mollie”) for processing donations via credit
card. This integration is optional for one-time donations, but required when the recurring
donations feature is enabled.

  • The Mollie integration is activated when you configure your Mollie API credentials in the plugin
    settings; it is mandatory if recurring donations are enabled
  • Only credit card payments are supported through the Mollie integration
  • When enabled, donor data (name, email, donation amount, currency, payment details) is transmitted to
    Mollie’s API at api.mollie.com
  • You are responsible for complying with Mollie’s Terms of Service and Privacy Policy
  • You must obtain your own Mollie account and API credentials; the Author does not provide Mollie
    credentials
  • The Author is not responsible for Mollie’s availability, fees, transaction failures, or changes to
    their service
  • Recurring donations processed via Mollie are subject to Mollie’s own recurring payment terms

8.2 Advanced Reports

FundCollector Pro provides advanced reporting and analytics features including charts, CSV export, and PDF
receipt generation.

  • Reports are generated based on the data stored in your WordPress database; their accuracy depends on
    the completeness and integrity of that data
  • The Author does not warrant that reports will be accurate, complete, or suitable for accounting,
    legal, or tax purposes
  • You are solely responsible for verifying the accuracy of exported data before using it for any
    official purpose
  • CSV exports and PDF receipts are provided as convenience tools; you must maintain your own
    authoritative records
  • The Author is not liable for decisions made based on report data

8.3 Backup and Restore

FundCollector Pro includes a backup and restore system for donation data.

  • Backup files contain donation records and plugin configuration data stored in your WordPress
    database
  • The Author does not warrant that backup files will be complete, uncorrupted, or successfully
    restorable in all circumstances
  • Backup files do not replace a full website or database backup; you remain responsible for
    maintaining comprehensive backups of your entire WordPress installation
  • Restore operations may overwrite existing data; you are responsible for verifying the integrity of
    backup files before restoring
  • The Author is not liable for any data loss, corruption, or unintended consequences resulting from
    backup or restore operations
  • Backup files should be stored securely; they may contain personal donor information subject to data
    protection regulations

9. Updates and Support

9.1 Software Updates

The Author may provide updates, bug fixes, and new features at their discretion. However:

  • Updates are provided “as is” without warranty
  • There is no guarantee of regular updates or ongoing development
  • Updates may introduce new bugs or compatibility issues
  • You are responsible for testing updates before deploying to production
  • The Author may discontinue development at any time

9.2 Technical Support — Free Version

For the free version of the Plugin:

  • Support is provided on a best-effort basis only
  • There is no guaranteed response time or resolution
  • Support may be discontinued at any time
  • The Author is not obligated to provide support or assistance

9.3 Technical Support — FundCollector Pro

Active Pro license holders are entitled to premium support via email at support@fundcollector.net. However:

  • Premium support is available only during the active license period
  • Response times are provided on a best-effort basis and are not guaranteed
  • Support covers the standard use of FundCollector Pro features; it does not cover custom
    modifications, third-party plugin conflicts, or server configuration issues
  • The Author reserves the right to modify support terms at any time

10. Modifications and Customizations

You may modify FundCollector to suit your needs, but you acknowledge that:

  • Modified versions are your responsibility and provided without warranty
  • The Author is not liable for issues arising from modifications
  • Support may not be available for modified versions
  • Modified versions must comply with GPL v2 license terms
  • You should document all modifications for future reference

11. Indemnification

You agree to indemnify, defend, and hold harmless the Author and copyright holders from any claims,
damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the Plugin
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your non-compliance with applicable laws or regulations
  • Any transactions or donations processed through the Plugin
  • Any data breaches or security incidents

12. Termination

These Terms remain in effect until terminated. You may terminate your use of the Plugin at any time by
uninstalling it. The Author may discontinue the Plugin at any time without notice.

Upon termination:

  • You must cease all use of the Plugin
  • You retain responsibility for any data collected while using the Plugin
  • Sections regarding limitations of liability and indemnification survive termination

For FundCollector Pro, termination of the license (expiry or revocation) does not entitle you to a
refund unless the conditions in section 2.2 are met.

13. Changes to Terms

The Author reserves the right to modify these Terms at any time. Changes will be effective immediately
upon posting. Your continued use of the Plugin after changes constitutes acceptance of the modified
Terms.

It is your responsibility to review these Terms periodically for changes.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to
its conflict of law provisions.

Any disputes arising from these Terms or the use of the Plugin shall be subject to the exclusive
jurisdiction of the court of Rome, Italy.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining
provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the GNU General Public License v2, constitute the entire agreement between you
and the Author regarding the use of FundCollector and FundCollector Pro and supersede all prior
agreements and understandings.

18. Acceptance of Terms

By downloading, installing, or using FundCollector or FundCollector Pro, you acknowledge that
you have read these Terms and Conditions, understand them, and agree to be bound by
them.

If you do not agree to these Terms, you must not use the Plugin.
